Privacy policy for the website www.toolmet.pl dated 23.05.2018r. and policy of using the so-called „Cookies”

Zakład Mechaniki Precyzyjnej “Toolmet” as the owner of the website www.toolmet.pl, hereinafter referred to as the Administrator, makes every effort to ensure that your privacy is properly protected. In order to implement a lawful, transparent and secure processing of your personal data, we accept the following privacy policy.

In accordance with the Article 13 of the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) hereinafter referred to as Regulation or GDPR, we inform that:

1.  General information

b.  Toolmet Company doesn’t appoint the Inspector of Data Protection. In matters concerning your personal data, you can  contact to the email address: toolmet@wp.pl

c.  The User within the meaning of this Privacy Policy is a natural person using the Administrator’s websites, including the Administrator’s contact forms, and the customer panel

d.  The contact form is a tool to make contact with the Administrator easier. The contact form is available to all visitors of the Administrator’s website. By using the contact form, you accept this Privacy Policy

e.  The customer panel available in “My account” section is a tool available only to regular customers of Toolmet Company. The customer panel allows you to create and send product order lists that are on Toolmet’s offer. Login data will be provided by the Administrator only on request of interested contractors of Toolmet Company. The customer panel is not an online store. By using the customer panel, you accept this Privacy Policy

2.  Purpose of personal data processing

a.  The User provides personal data to the Administrator to handle the inquiry or order placed via the contact form or customer panel.

b.  Providing personal data by the User during contact is voluntary, and the provided data will be used only for the purposes of:

a.  provide answers

b.  sending commercial information and current offers regarding products offered by the Toolmet company

c.  sale of goods / services and products offered by the Toolmet company

d.  protection of the Administrator’s network systems (e.g. protection against spam and DDOS attacks).

e.  measurement and analysis of visits of the Administrator’s website

c.  your consent to the processing of personal data by providing contact details is voluntary, but in some cases not provide them may prevent the handling of an inquiry / order submitted via the contact form or customer panel

3.  The legal basis for data processing by the Administrator.

a.  The legal basis for the processing of personal data for the purposes specified in 2.b.a, 2.b.b. and 2.b.c. constitutes the User’s consent in accordance with Art.6 Section 1 lit.a. GDPR, and / or Article 6 Section 1 lit b, c GDPR if the User wishes to conclude a contract.

b.  The premise for the processing of personal data for the purpose specified in 2.b.d is the legitimate interests pursued by the Administrator Art.6 Section 1 lit f GDPR, and the legal basis is Subject 49 GDPR

c. The premise for the processing of personal data for the purpose specified in 2.b.e. is the legitimate interests pursued by the Administrator Art.6 Section 1 lit f GDPR, and the legal basis is Art.8 Section 1 lit d Regulation Of The European Parliament And Of The Council concerning the respect for private life and the protection of personal data in electronic communications and repealing Directive 2002/58/EC (Regulation on Privacy and electronic Communications)

4. The scope of data processing by the Administrator

a. for the purposes indicated in 2.b.a, 2.b.b. and 2.b.c. to the extent that the User voluntarily provides, the Administrator may process:

a.  Name and Surname

b.  Company registration details

c.  Contact phone numbers

d.  Correspondence addresses, delivery addresses

e.  Email addresses

f.  Internet domain address (and any other related data provided by the User)

g.  other data provided by the User

b.  for the purposes indicated in 2.b.d

a.  IP address

b.  metadata sent by the browser (or other end device connecting to the Administrator’s website)

c.  for the purposes indicated in 2.b.e

a.  metadata sent by the browser

d. recipients of the personal data and providing to a third parties

a.  personal data of the User related to the purposes mentioned in points 2.b.a. up to 2.b.d. will be processed by:

i.  Administrator (Controller of the personal data)

ii.  the entities authorized by law

iii.  accounting offices, law offices

iv.  entities involved in the sale of goods / services

v.  entities providing postal, courier and transport services

vi.  entities providing IT support for the Administrator

b.  data related to the purposes mentioned in points 2.b.e. will be processed by the Administrator and partners:

i.  Google Inc. USA which provides tools for the web audience measuring (Google Analytics). These data are anonymous and are not shared.

ii.  Slimstat Analytics tools, used to measure and analyze visits of the Administrator’s website. These data are anonymous and are not shared.

e.  Your personal data will not be processed in an automated way, including profiling

5.  Rights of the User whose data is processed.

a.  In accordance with the GDPR the User has right to:

a.  access the data being processed and obtain a copy of it

b.  correct your data

c.  request deletion of the data being processed

d.  demand limitation of data processing

e.  transfer data

f.  object to the processing of data

g.  revoke your consent to the processing of the personal data

b.  To execute their rights, the User should send an e-mail to the address given in 1.a., or a letter to the address of the registered office given in 1.a. or contact by phone at the number provided in 1.a.

c.  The Administrator carries out the User’s request without delay, with the proviso that deleting or limiting the possibility of data processing may affect the possibility or scope of proper handling of the submitted inquiry / order

6.  The period of personal data processing by the Administrator.

a.  The administrator stores the personal data of the User for no longer than is necessary to complete the request, including the preparation of a personalized commercial offer. We don’t pass these data on without your consent

b.  the User may submit a request to delete his personal data sent via contact request. In this case, they will be deleted immediately, but this may result in the interruption the handling of the query

c.  The Administrator stores the personal data of Users who are contractors throughout the entire period of cooperation, and after termination of cooperation until the purpose of their storage ceases, in accordance with mandatory statutory provisions – in particular statutory retention periods of accounting documents.

7.  The policy of using the so-called “Cookies”.

a.  The website does not collect information in an automated way, except for the information contained in Cookies

b.  Cookies are small text files that are placed on your computer and stored by your browser. The purpose of cookies is to ensure the correct operation of the website and to make our website more user friendly, effective and more secure. Cookies do not cause any damage to your computer and do not contain viruses. Cookies may contain e.g.: website address from which they come, validity time (storage time on the end user device), unique number.

c.  Session Cookies – temporary text files, automatically deleted after your log out or leave our site

d.  Persistent Cookies – text files stored on the User’s end device until their expiration or until they are deleted by the User. These cookies enable us to recognize your browser the next time you visit our website.

e.  Cookies indicated in 7.b,c,d will be used by the Administrator only to the extent necessary to provide the services requested by the User, including:

a. log in and maintain the User’s session

b. adjusting the content of the website to the User’s individual preferences, Cookies files allow to recognize User’s device to display the page in accordance with his preferences

c.  creating anonymous statistics excluding the possibility of user identification

f.  The website may use tool for analyzing web statistics (Google Analytics) provided by Google Inc. with its headquarters in the USA. This tool can save data (e.g. cookies) on User’s end device. The User may not agree to this by blocking the saving of Cookies and other data from the websites of external entities in the browser.

g.  The website uses the Slimstat Analytics web traffic analysis tool. This tool can save data (e.g. cookies) on User’s end device. The User may not agree to this by blocking the saving of Cookies and other data from the websites of external entities in the browser.

h.  By using our website, you agree to use cookies.

i.  The user can customize the settings of the browser to receive notifications every time cookies are placed and to accept cookies only in specific cases. The user may block the saving of Cookies for specific situations or in general. The user can activate the automatic deletion of cookies after the closing the browser. The user may at any time delete cookies using the features available in the web browser. Restricting the use of Cookies may affect some of the functionalities available on the website.

k. This website uses Google Maps, a mapping / location service, via an API which provider is Google Inc. USA. Google Maps will store your IP address, and as a rule it’s subsequently transferred to a Google server in the USA, where it is stored. Administrator does not have any control over data transferred by Google Maps. 8.  Filing a complaint:

a.  In the case of finding that the processing of the personal data violates the provisions of the GDPR Regulation, the user has the right to filling a complaint to the supervisory authority, that is to the President of the Office for the Protection of Personal Data (PUODO)
